Who Can Perform Self-Employment?

Who Issues Authorizations?

Activities for the exercise of self-employment are issued by the heads of the entities

1. Municipal Directorate of Labor
2. State Traffic Unit.
3. National Insurance Company

How to Request Authorization for Exercise on Your Own?

The authorization is obtained from the request of the Interested Party to the entities that issue the authorization, located in the municipality of residence or where they reside when outside of it.

What must be presented in the DMTSS to request the exercise of self-employment?

According to article 12 of Resolution 11/2018, the interested person must present:

• Request Brief
• Identity card
• (2) Two 1x1 photos
• Request for authorization to employ contract workers and draft employment contract or equivalent document, where the clauses and agreed conditions are specified.
• Authorization of the Historian or Conservator, as appropriate in the cases in which he intends to carry out the activity within the limits of the Priority Conservation Zone; and

Other documents required by the entity that issues the authorization, in correspondence with the activity to be carried out.

The application brief referred to in the preceding article contains the information on the following aspects:

1. Description of the activity you intend to carry out and the place where you are going to carry it out;
2. sworn declaration of the origin of the source of financing and the investments made or to be carried out in the activities: Landlord of housing, rooms and spaces; Automotive equipment grease scrubber; Blacksmith, Bodybuilding Gym Instructor; Recreation equipment operator; Baker-confectioner; Producer selling footwear; Sheet metal service; Building construction, repair and maintenance services; Gastronomic service in cafeteria; Gastronomic service in restaurant; Bar and recreation service; Transportation of cargo and passengers with automotive, rail and maritime means;
3. Origin of the equipment and means, when appropriate;
4. Compliance with Physical Planning, Hygiene, Food Safety, Rational Use of Water, Environment and Fire Protection standards, when applicable;
5. Interest in using posters, artistic services or both;
6. Production or service schedule, in correspondence with the provisions of the Council of the Administration of People's Power; and
7. Source of origin of the interested party for the purposes of affiliation to social security. When the request is to carry out activities in dwellings, rooms or spaces, in which acts constituting a crime have been committed on the occasion of the exercise of self-employment, the empowered authority does not issue a new authorization.

Terms for the delivery of the processes.

ARTICLE 14. Once the application has been evaluated, in the cases that the authorization is appropriate, the supporting document is prepared for the signature by the head of the entity, which issues it within a period of no more than ten (10) business days, with the exception of activities that require a prior evaluation of the multidisciplinary groups created for this purpose.

If the procedure is not approved, the applicant is verbally notified by the official designated by the entity that issues the authorization.

For the activities authorized by the entities in charge of granting transport operation licenses, designated by the Ministry of Transport, the terms established in its specific regulation are met.

ARTICLE 15. The authorization to carry out the activities detailed below is granted after evaluation and verification by the multidisciplinary group chaired by the person designated by the Council of the Municipal Administration of People's Power and made up of representatives of the directorates of Work, Physical Planning, Public Health, the National Tax Administration Office, of the Ministry of Tourism, and others that are required, according to the activity under evaluation, to verify that the requirements for the exercise of the activity are met, without require no formality from third parties; these activities are:

1. a) Landlord of housing, rooms and spaces, when up to four (4) are leased

Rooms or spaces;

b) Sawmill;

c) Carpenter;

d) Breeder or caretaker of animals for rental, marketing or other services

Related;

e) Leather tanner;

f) Grease scrubber of automotive equipment;

g) Blacksmith;

h) Bodybuilding gym instructor;

i) Recreation equipment operator;

j) Baker-confectioner;

k) Producer or seller of religious articles or other resources for these purposes;

l) Producer seller of cast articles;

m) Producer seller or collector seller of materials for construction purposes;

n) Repairman of mechanical and combustion equipment;

o) Sheet metal service;

p) Decoration services, organization of birthdays, weddings and other festive activities;

q) Gastronomic service in cafeteria;

r) Welder; and

s) Others that the Council of the Municipal Administration of People's Power determines.

The deadline to carry out the evaluation and notify the result to the applicant is up to thirty (30) calendar days.

ARTICLE 16. The authorization to carry out the activities of gastronomic service in a restaurant, bar and recreation service and landlord of housing, rooms and spaces, when whole houses or more than four (4) rooms are rented, is issued after evaluation by the group multidisciplinary, chaired by the person appointed by the Council of the Provincial Administration of the People's Power or the special municipality of Isla de la Juventud and made up of representatives from the Directorates of Labor, Physical Planning, Culture, Commerce, Public Health, the Fire Department , the National Tax Administration Office, of the Ministry of Tourism, the corresponding Control bodies and others that are required, at the proposal of the multidisciplinary group created in the Council of the Municipal Administration of People's Power, once the corresponding analysis has been carried out.

The deadline to carry out the evaluation and notify the applicant of the result is up to

Ninety (90) calendar days.

ARTICLE 17. The authorization to carry out self-employment is accredited by a document issued by the issuing entity, the model of which appears in Annex No. 2, which forms an integral part of this Resolution.

To exercise the activity, the worker is obliged to join the special social security regime when appropriate and register in the Taxpayer Registry of the corresponding National Tax Administration Office, within a period of up to fifteen (15) calendar days from once the authorization has been issued.
